e-SIR: the new electronic procedure can be used from March 17

In recent months, there have been important changes in waste regulations affecting the management of WEEE (RD 110/2015), the management of batteries and accumulators (RD 710/2015) and the shipment of waste (RD 553/2020).

Within this changing legislative landscape, the Royal Decree on the transfer of waste stands out since, despite maintaining several articles of RD 833/1988, it repeals RD 180/2015 and adds significant novelties that affect a large part of the professionals in the sector.

The e-SIR platform, mandatory for any transfer with prior NT

Among the most impactful changes brought about by RD 553/2020 is the mandatory use of the e-SIR platform or Waste Information System. This new platform of the Ministry for Ecological Transition and Demographic Challenge (MITERD) includes three parts:

  • The Production and Management Register (RPGR), where all producers, managers, transporters, agents and traders registered in Spain will be listed.
  • The transfer repository, which collects all transfer notices (NT) and identification documents (DI).
  • The repository of managers' annual reports.

Beyond the difficulties of its implementation, the use of the e-SIR platform will be indispensable in some Autonomous Communities for any transfer subject to prior notification.

The new electronic procedure will be available for use as of March 17

MITERD has just published the procedure on the shipment of waste within the State's territory, which can be used from March 17, 2021which will be available for use from March 17, 2021, and will be mandatory as of July 1, 2021.

It details the steps for the implementation of electronic processing through the e-SIR. In particular, it indicates how the shipment operator has to submit the Prior Notification and the Identification Documents and how the acceptance or rejection of the waste by the destination manager is carried out.

In this procedure, the Ministry reminds that electronic processing is only required for shipments of waste subject to Prior Notification (art. 3.2, RD 553/2020):

  • Shipments of hazardous and non-hazardous waste for disposal;
  • Shipments of hazardous waste, mixed domestic waste identified with LER code 20 03 01 and those to be determined by regulations, destined for recovery.

According to MITERD data, the following Autonomous Communities and autonomous cities will use the Ministry's procedure for waste shipments between autonomous communities and/or waste shipments within their autonomous community (intra-territorial shipments).

In accordance with the above, all shipment operators who have to process a waste movement (remission of Prior Notification and Identification Documents) with origin in one of the Autonomous Communities indicated above, must use the Ministry's procedure. Likewise, destination managers who have to accept or reject the waste through the completion of the specific section of the Identification Document must use the Ministry's procedure when the destination treatment facility is located in one of the Autonomous Communities indicated above.

The specific electronic procedure established in the MITERDD's electronic office should be used for the specific electronic procedure established in the MITERD's electronic headquarters..

On the other hand, for the remission of the Identification Documents by the shipment operator, as well as for the acceptance or rejection of the waste by the destination managers, the procedure offered by e-SIR must be used. offered by e-SIR here.

Galicia is the only Autonomous Community that has opted out and will continue to use its GaIA platform for all waste shipments, although it qualifies changes in the operative.

Movements of waste within an autonomous community

The second additional provision of Royal Decree 553/2020 indicates that for waste movements with origin and destination within the autonomous community, procedures consistent with the aforementioned regulation must be established, particularly with respect to the DI, the TC and the NT.

The autonomous communities that have not decided to use the MITERD procedure for intra-territorial movements must indicate which procedure they will use on their respective web pages.

What about current waste movements subject to an existing prior notification?

If the previous TR has been submitted prior to the implementation of the electronic procedure and is still in force, the identification documents must be submitted to the origin and destination Autonomous Communities through the procedure established by them for this purpose.

Once the period of validity of the prior notification has expired, new notifications must be sent by electronic procedure.

According to these data, it is foreseeable, therefore, that as of March 17 there will be changes in the waste transfer procedures of the different territories.
